Georgia six-week abortion ban is unconstitutional, a Fulton County Superior Court judge ruled Monday, allowing it abortions in the state occur later in pregnancies.

The order means Georgia cannot enforce the six-week ban that came into effect in 2022. Abortions can continue to be performed until around 22 weeks of pregnancy, which was the case before the ban.

Fulton County Superior Court Judge Robert McBurney wrote in his ruling: “While the state's interest in protecting 'unborn' life is compelling, unless that life can be preserved by the state, the balance of rights favors the woman.” .”

“For these women, freedom of privacy means they alone can decide whether to act as human breeding grounds during the five months until viability,” McBurney wrote. “It is not the job of a lawmaker, a judge, or a commander of The Handmaid's Tale to tell these women what to do with their bodies in this time when the fetus can no longer survive outside the womb than society can “It could – or should – force them to serve as a human tissue bank or give up one kidney in favor of another.”

If the Supreme Court overturned the landmark Roe v. calf The decision in 2022 made Georgia one of the states where an automatic ban was triggered. Georgia's 2019 law, which bans abortions once cardiac activity is detected, typically about six weeks into a pregnancy, then went into effect.
